This document serves as formal authorization from Dart Container Corporation ("Dart"), located at 500 Hogsback Road, Mason, MI 48854, permitting JazzSoloGear.com to sell products featuring the copyrighted "Jazz" design. This authorization is granted based on the following terms and conditions:
- Authorization Scope: Dart Container Corporation authorizes JazzSoloGear.com to display and sell items that incorporate the "Jazz" design on its website. This authorization includes but is not limited to apparel, home goods, bags, and related products that do not align with the design's original artistic purpose (disposable tableware).
- Use of Trademark and Copyright: JazzSoloGear.com may use the "Jazz" design on approved products listed on its website, including marketing materials related directly to the sale of these products, under the condition that all items adhere to Dart's quality standards and usage guidelines.
- Duration and Termination: This authorization remains effective as of the date of issuance and will continue indefinitely unless terminated in writing by Dart Container Corporation. Dart reserves the right to revoke this authorization at any time if terms are breached or for any other reason deemed necessary by Dart.
- Intellectual Property Rights: Dart Container Corporation retains full ownership of the "Jazz" design copyright and any related intellectual property rights. This authorization grants JazzSoloGear.com limited rights to sell and market products featuring the design but does not transfer any ownership rights.
- Non-Transferability: This authorization is exclusive to JazzSoloGear.com and may not be transferred or sublicensed to any third party without prior written consent from Dart Container Corporation.
